Fast Facts About Uncontested Divorce in Middlesex County
Middlesex County is the second busiest (highest volume of divorce filings) in the State of New Jersey. Approximately 5800 divorce complaints (whether contested or uncontested) are filed each year in Middlesex County. Whether you are a resident of one of the townships bordering Interstate 95 and the New Jersey Turnpike, such as Woodbridge, Edison, New Brunswick, or Piscataway, or you live in a community bordered by Route 9, such as Old Bridge, or Route 287, such as Perth Amboy, your divorce action will be commenced by filing the appropriate papers in New Brunswick.
The timeframe for an uncontested divorce to move through the system in Middlesex County is slightly below average. From the date of filing to the grant of a final judgment of divorce takes about 2-3 months if the parties are cooperative, and sign and return the required paperwork in a prompt manner.
From my experience Middlesex County judges are quite accommodating to requests to have an out-of-state, or out-of-country party (husband or wife) appear via telephone. I have had military clients and businesspersons working overseas who have been able to participate to the extent necessary to finalize an uncontested divorce by telephone appearance. I have also had the experience of receiving permission from a Middlesex County Judge to have an uncontested divorce processed with no court appearance required by either party (husband or wife). This process requires a little extra work, but it can be accomplished by submitting more detailed paperwork, and a few extra affidavits. Middlesex county judges do not require proof of the marriage (i.e. a marriage certificate) to process an uncontested divorce, and there is no extra fee in Middlesex County to receive a gold seal on the Judgment of Divorce.
