Fast Facts About Uncontested Divorce in Bergen County
Bergen County is one of the busiest (high-volume) court systems in the State of New Jersey. In total approximately 7000 contested and uncontested divorce cases are filed in Bergen County each year. All Bergen County residents seeking a divorce must file their divorce complaint in Hackensack, whether they live in the Route 4 corridor towns of Fort Lee, Englewood, Teaneck or Hackensack; the Route 9W communities of Palisades Park and Cliffside Park; the Interstate 95 towns like Rutherford, Lyndhurst, and North Arlington; the communities serviced by Route 208 like Fairlawn and Garfield, or towns such as Paramus, Mahwah and Ridgewood, which are located off the Garden State Parkway and Route 17 North/South corridor.
Although Bergen County has a very busy divorce caseload the entire divorce timeframe from filing to grant of divorce is quite quick. Once the divorce complaint is filed it takes approximately 7-10 days to get the docket number assigned to the case. Cases assigned to the uncontested divorce or default calendar in Bergen County can move very quickly from filing to granting of the divorce. The average timeframe is 2-3 months.
Day of Divorce
After all of the necessary paperwork is filed and accepted by the Court a court date is set approximately 6 weeks after the court has approved the paperwork. In my experience in Bergen County the Judges move the uncontested divorce docket quickly on the court date. Bergen County judges generally require an in-person appearance in their courtroom in Hackensack by the plaintiff (person filing for the divorce) and satisfactory in-person court testimony from the plaintiff before they consider granting a divorce. In my experience persons in the active duty military have been able to testify via telephone. Bergen county Judges do not take their cases individually, i.e., all parties for all cases assigned to that Judge on that day sit in the same courtroom, and hear each other’s testimony as they wait their turn for their case to be called. After the divorce is granted you will receive the Judgment of Divorce with a gold seal attached (making your copy official). Unlike some other counties, generally you do not have to pay a separate fee to receive the gold seal on your divorce judgment.
