Burlington County Uncontested Divorce – Fast Facts
More than 3700 divorce cases are filed each year in Burlington County. Residents of Willingboro, Pemberton, Evesham, Maple Shade, Medford, Mount Laurel, Cinnaminson, Moorestown, and Burlington County’s smaller townships are required to file their uncontested divorce papers at the Superior Court, Family Part in Mount Holly.
The average timeframe for an uncontested divorce to go from filing to final judgment of divorce is 2-3 months if the served spouse (the defendant) cooperates with signing the necessary papers on a timely basis. After the court has all of the required paperwork the case is placed on the calendar for a final hearing.
At the final hearing, I will accompany you to court, and take you through the required testimony to enable the court to grant the divorce. After the testimony is presented to the court, the assigned judge will rule on the testimony offered and grant the divorce. You will leave the courthouse with the written, signed divorce judgment.
Interestingly, unlike the majority of counties, Burlington County judges inquire about the plaintiff’s prior marital history, i.e., have you been divorced previously. If so, this is stated on the record. However, whether you have had a prior divorce has no effect on whether the present divorce will be granted.
If you are active duty military, or you have relocated outside of the State, telephone testimony may be admissible if court permission is sought and granted prior to the court date for the final hearing.
